Manage your project in Morocco from abroad

I live abroad and have a project in Morocco that I'd like to manage remotely. How do I go about it?

Thanks to new technologies, you can stay at the core of your project even from a distance. You also have a number of management solutions at your disposal, such as power of attorney and delegation of authority, which can limit the number of times you have to travel. In fact, adopting a well-thought-out organization will ensure that you don't waste time in unnecessary exchanges with your colleagues. It is therefore essential to maintain regular but well-defined day-to-day contact with trusted local contacts.

Whether you're a sole shareholder or a partner, if you're the main manager in a project and you live abroad, it's vital to give your employees more autonomy. Trusting and empowering each team member will help you create a healthy climate and motivate the whole group.

It would also be a good idea to set up a management committee that would meet with you by videoconference at least twice a week to monitor your company's actions in detail.

You'll also need to adapt your working rhythm to Moroccan time, despite the time difference. This will show your teams that you take their working conditions into consideration and are prepared to be flexible to accommodate them.

However, your presence may sometimes be inevitable to manage certain situations. So don't hesitate to budget for emergency travel to Morocco.

A power of attorney is a legal document that enables a proxy (a third party outside the company) to act on your behalf. This solution is useful when you are unable to be present for a particular situation.

In the case of company management, to be accepted, the power of attorney must precisely state all the responsibilities, rights, limitations and conditions precedent of the mandatary. The attorney-in-fact may not exceed the terms of the power of attorney.

In some cases, the power of attorney must be drawn up by a notary in the form of an authenticated deed. Alternatively, a private power of attorney can be drawn up quickly and easily at Morocco's consular offices abroad. For it to be valid, it must indicate the identity of both parties, the nature of the mandate and its duration.

Delegation of authority is a document which attests to the transfer of responsibilities from an authority (the delegator) to a subordinate (the delegatee). It enables the delegate to perform agreed legal and administrative acts on behalf of the company, usually to relieve the delegator of part of his workload.

However, unlike a power of attorney, the delegate must not only be part of the company and in a subordinate position, but must also have the authority, skills and resources required to carry out the delegation.

Before choosing this remote management solution, remember to check that your company's articles of association do not prohibit the director from delegating his or her powers. Also, make sure you identify the parties concerned, include a period of validity, detail the delegated powers with an exhaustive and unequivocal list, the means made available, as well as a clause on the delegatee's obligations.
